TERMS OF USE
1. About These Terms
VocabStorage is a language-learning service operated by a sole proprietorship based in Alberta, Canada. In these Terms, “VocabStorage,” “we,” “us,” and “our” refer to the proprietor operating under the registered business name VocabStorage.
These Terms govern your access to and use of the VocabStorage website, mobile applications, and language-learning service, including vocabulary tools, grammar exercises, AI-generated content, and automated feedback (collectively, the “Service”).
By creating an account, accepting these Terms, or using the Service, you agree to be bound by them. If you do not agree, you must not use the Service.
Our Privacy Policy explains how we collect, use, disclose, process, and retain personal information.
2. Eligibility
You must be at least 16 years old to create or use a VocabStorage account.
If you are at least 16 years old but have not reached the age of majority where you live, you may use the Service only with the permission of a parent or legal guardian.
By creating an account or using the Service, you represent that you meet these requirements.
3. Your Account
You agree to provide accurate account information and keep it reasonably up to date.
You must take reasonable steps to protect your account credentials and notify us promptly if you suspect unauthorized access to your account.
You must not impersonate another person or use another person’s account without authorization.
You are responsible for activities performed through your account unless they result from circumstances outside your reasonable control.
4. Learning Features and AI Content
The Service provides tools for vocabulary and grammar practice. Some exercises, translations, explanations, and feedback are generated or evaluated using artificial intelligence.
AI-generated or AI-evaluated content may be inaccurate, incomplete, inconsistent, or unsuitable for a particular context. Automated feedback may incorrectly assess an answer.
We do not guarantee that all educational content will be correct or that use of the Service will produce any particular learning result. You should use your judgment and verify content when accuracy is important.
We may change the AI models, providers, and technical implementation used to provide these features.
5. Free and Paid Features
The Service includes a free plan and may offer paid subscription plans. Available features, usage limits, prices, currencies, billing periods, and any introductory offers are described in the Service or at checkout.
Paid subscriptions renew automatically for the billing period you select unless canceled before renewal.
Depending on where you purchase a subscription, payment may be processed by Stripe, Apple through the App Store, or Google through Google Play.
By purchasing a subscription, you authorize the applicable payment provider to charge the displayed subscription price, applicable taxes, and any other amounts disclosed at checkout until the subscription is canceled.
Subscriptions purchased through the App Store or Google Play are also subject to the applicable store’s payment and subscription terms.
If a payment fails or a subscription expires, is canceled, or is refunded, we may restrict access to paid features and return the account to the free plan.
6. Cancellation and Account Deletion
You may cancel a subscription purchased directly from VocabStorage through the subscription-management options available in your account. If you cannot access those options, contact support@vocabstorage.com.
Subscriptions purchased through the Apple App Store or Google Play must be managed and canceled through the applicable store account and subscription settings.
Ordinary subscription cancellation takes effect at the end of the current paid billing period. Unless the applicable payment provider or applicable law provides otherwise, paid access continues until that date, after which the subscription will not renew.
Deleting your VocabStorage account is different from canceling a subscription.
Deleting your account cancels automatic renewal of a subscription purchased directly from VocabStorage.
Deleting your VocabStorage account does not automatically cancel a subscription purchased through the Apple App Store or Google Play. You must cancel any store subscription through the applicable store before deleting your account to prevent future charges.
Account deletion ends your access to the Service and is handled as described in our Privacy Policy.
Deleting your account or canceling a subscription does not automatically entitle you to a refund. The refund provisions below continue to apply.
7. Refunds
7.1 Purchases Made Directly from VocabStorage
Except where required by applicable law or expressly offered by us, subscription payments made directly to VocabStorage are non-refundable, including payments for unused portions of a billing period.
We will refund duplicate charges confirmed to have been made in error. We may consider other refund requests at our discretion based on their circumstances.
To request a refund for a direct purchase, email support@vocabstorage.com with your account email address and a description of the issue. Do not send full payment card details.
7.2 Apple App Store Purchases
Refund requests for subscriptions purchased through the Apple App Store must be submitted to Apple and are handled under Apple’s policies and applicable law.
7.3 Google Play Purchases
Refund requests for subscriptions purchased through Google Play are handled under Google Play’s policies and applicable law. Where appropriate, you may submit the request through Google Play or contact us at support@vocabstorage.com.
7.4 Mandatory Rights
Nothing in these Terms limits any mandatory refund, cancellation, withdrawal, or other consumer rights. Refunds required by applicable law are not subject to our discretion.
8. Changes to Prices and Features
We may update the Service’s features, usage limits, free-plan restrictions, and subscription offerings.
If we change the price of an existing subscription purchased directly from VocabStorage, we will provide advance notice and an opportunity to cancel before the new price applies. A price change will not increase the price of a billing period that has already been paid for.
Price changes for subscriptions purchased through the Apple App Store or Google Play will be handled according to the applicable store’s rules, including any required notice or consent.
Where a change materially affects a paid service, we will provide any notice or remedies required by applicable law.
9. Acceptable Use
You must not:
Use the Service for unlawful, fraudulent, abusive, or harmful activity.
Attempt to access another user’s account or information without authorization.
Attempt to bypass authentication, security controls, subscription restrictions, or usage limits.
Disrupt, damage, overload, or interfere with the Service or its infrastructure.
Introduce viruses, malicious software, or other harmful code.
Use automated tools to overload the Service, create accounts in bulk, or extract content or data without authorization.
Reverse engineer, decompile, or attempt to obtain the Service’s source code except where such restriction is prohibited by law.
Submit content that infringes another person’s intellectual property, privacy, or other legal rights.
Use the Service in a way that could expose VocabStorage, its users, or service providers to legal liability or security risks.
We may remove content, limit functionality, or restrict access where reasonably necessary to address violations, protect users, maintain security, or preserve the operation of the Service.
10. Your Content
You retain any rights you hold in content you submit to the Service.
You grant us a non-exclusive, worldwide license to host, store, reproduce, transmit, and process that content only as reasonably necessary to operate, maintain, secure, and provide the Service.
This includes transmitting relevant exercise information and submitted answers to artificial intelligence service providers for exercise generation, answer evaluation, and feedback.
This license does not transfer ownership of your content to us. Our processing of personal information remains subject to our Privacy Policy.
You must have the rights and permissions needed to submit your content.
You should not include sensitive information or unnecessary personal information about yourself or another person in vocabulary entries, exercise answers, support messages, or other submitted content.
11. Our Intellectual Property
The Service’s software, branding, design, interfaces, databases, and content owned by us or our licensors are protected by applicable intellectual property laws.
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, and revocable right to use the Service for your own language-learning purposes.
You may not copy, redistribute, sell, license, publicly display, commercially exploit, or create unauthorized derivative works from protected parts of the Service except where authorized by us or permitted by applicable law.
These Terms do not grant us ownership of content you submit.
AI-generated outputs may not be unique. Other users may receive identical or similar outputs. We do not guarantee that AI-generated content is eligible for intellectual property protection or that you will have exclusive rights to it.
12. Third-Party Services
The Service may rely on or provide access to third-party services, including payment processors, authentication providers, artificial intelligence providers, analytics providers, email providers, app stores, and external links.
Your use of a third-party service may be subject to that provider’s own terms and privacy practices.
We are not responsible for third-party services that we do not control. However, this does not limit any responsibility that cannot lawfully be excluded.
13. Suspension and Termination
We may suspend or terminate access to the Service for a material breach of these Terms, unlawful activity, serious misuse, security risks, or failure to pay applicable fees.
Where reasonably practicable, we will provide notice and an opportunity to resolve the issue. Immediate action may be necessary in cases involving fraud, serious misuse, security threats, harm to other users, or legal requirements.
We may discontinue all or part of the Service. If discontinuation affects a prepaid subscription purchased directly from VocabStorage, we will address unused prepaid fees in accordance with applicable law and any commitments made to you.
Subscriptions purchased through the Apple App Store or Google Play may also be subject to the applicable store’s procedures.
You may stop using the Service at any time. Subscription cancellation and account deletion are governed by Section 6.
14. Disclaimers
To the extent permitted by applicable law, the Service is provided “as is” and “as available.”
We do not guarantee that the Service will always be available, uninterrupted, secure, or free from errors.
We do not guarantee the accuracy, completeness, suitability, or reliability of exercises, translations, explanations, AI-generated content, automated evaluations, or feedback.
The Service is intended as a language-learning aid and is not a substitute for professional translation, educational, legal, medical, immigration, or other professional advice.
Nothing in these Terms excludes warranties, guarantees, conditions, or remedies that cannot lawfully be excluded.
15. Limitation of Liability
To the extent permitted by applicable law, VocabStorage will not be liable for indirect, incidental, special, consequential, or punitive losses arising from or relating to your use of, or inability to use, the Service.
This includes loss of data, loss of opportunity, loss of revenue, loss of profits, or interruption of business, where such losses are not a direct and reasonably foreseeable result of our breach.
Subject to the exceptions below, our total liability arising out of or relating to the Service will not exceed the amount you paid directly to VocabStorage for the Service during the twelve months preceding the event giving rise to the claim.
These limitations do not apply to fraud, willful misconduct, gross negligence where liability cannot lawfully be limited, or any other liability that cannot lawfully be excluded or limited.
Nothing in this section restricts mandatory consumer rights or remedies available under applicable law.
16. Indemnification
To the extent permitted by applicable law, you agree to be responsible for reasonable losses, liabilities, claims, and expenses resulting from your unlawful use of the Service, your material breach of these Terms, or content you submit in violation of another person’s rights.
This obligation does not apply to losses caused by VocabStorage or circumstances outside your reasonable control.
17. Governing Law
These Terms are governed by the laws of Alberta and the federal laws of Canada applicable there.
This choice of law does not deprive you of mandatory protections available under applicable consumer laws in your place of residence.
Nothing in these Terms restricts any right you may have under applicable law to bring a claim before a competent court or regulatory authority.
18. Changes to These Terms
We may update these Terms as the Service, subscription offerings, providers, business practices, or legal requirements change.
When we update these Terms, we will revise the effective date.
We will provide notice of material changes and request renewed acceptance where appropriate or required by applicable law.
Changes will not retroactively remove rights relating to a dispute that arose before the updated Terms took effect.
If you do not agree to updated Terms, you may stop using the Service and cancel your subscription. Any applicable statutory rights remain unaffected.
19. General Provisions
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue in effect to the extent permitted by law.
Our failure to enforce a provision of these Terms does not waive our right to enforce it later.
You may not transfer your rights or obligations under these Terms without our consent. We may transfer these Terms as part of a sale, restructuring, financing, or transfer of the Service or business, subject to applicable law.
These Terms, together with the Privacy Policy and any additional terms presented for a specific feature or purchase, form the agreement between you and VocabStorage concerning the Service.
